7 incredible benefits of divorce mediation

You and your spouse have decided to split up after several years of marriage. You have kids together. Professionally, you have been very successful over the years.

In fact, that success is part of the reason for the divorce. You never really argued or even strongly disagreed with each other. You simply got busy. You both work long hours. Your companies come first. Finally, you both agreed to split up to focus on your careers.

Could mediation work for you?

The two of you may be prime candidates for divorce mediation. Couples who remain on relatively good terms can work together in mediation to sort out many of the things a judge would decide in court. Contentious divorce cases often need a judge because couples would never agree otherwise, but the two of you do not want a long legal battle. You are on the same page.

Some of the possible benefits of choosing mediation include:

  1. You retain control. A judge does not tell you how to divide assets or who gets to spend time with the children. While some things -- like child custody -- must get approved, you and your spouse get to make the decisions together.
  2. Compliance is higher. Probably because they each get to have a say, statistics show that couples who use mediation typically comply with the divorce agreement more easily than those who do not.
  3. Creativity reigns. You have more flexibility, and you and your spouse can get creative and think outside the box. You can really come up with the best solutions for your family.
  4. It's not public. If you go to court, much of what happens becomes public record. Mediation keeps things confidential. Since you are both business owners, you may like this. It keeps your personal life from having an impact on your professional life.
  5. You may feel more relaxed. Court cases tend to be formal and bring a lot of stress. Mediation is generally far more low-key and informal. That can make the process easier, especially when your kids are going to be involved. Do you really want to drag them to court?
  6. You could save money. Mediation is not free, but it typically costs less than a lengthy court case that drags on for months when you cannot agree.
  7. You could save time. The two of you want this divorce. You want what is best for your children. You want to move forward. Since you fundamentally agree, the whole process will likely be faster than fighting it out in court.

Remember that New Jersey divorce cases do not have to go into litigation. Make sure you understand all of your options.
