Why opt for mediation over going to court?

Divorce has long-lasting affects on those involved, especially if the couple in question has children. Many concerned parents in New Jersey want to do whatever they can to avoid confrontation and settle their differences in as amicable a fashion as possible. Those who are willing to peacefully discuss each topic of importance may want to use mediation to achieve a settlement rather than go to court.

This process often takes less time than litigation and may be more cost-effective as well. Many parents want to avoid the business-like environment of a courtroom. A mediated divorce allows them to come together in a private setting and allow a mediator to help them focus on their needs and children's best interests.

Because mediated settings allow spouses to retain control over the process, it typically means they also have greater control over the ultimate outcome of their situation as opposed to leaving it all up to a judge to decide. There is no fault, no winner or loser and no trying to gain the upper hand. Successful mediation often leads to successful co-parenting down the line because spouses prove they can work together and cooperate as necessary for the good of their children.

Certain issues are not discussed in a mediation setting, such as the marital problems that led to divorce. As such, it is a streamlined process that helps spouses work through their differences in order to come up with a plan that is agreeable and fair to both sides.
