How long does the divorce process take in New Jersey?

On Behalf of | Dec 2, 2024 | Divorce

If you’re wondering how long the divorce process takes in New Jersey, there is no definitive answer. The timeline varies, depending on factors like whether the divorce is contested or uncontested and other unique aspects of every situation. In most cases, the process can take a few months to over a year.

First, you must meet New Jersey’s residency requirements to file for divorce. You or your spouse must have been an in-state resident for at least one year. Additionally, some waiting periods may apply before the legal process can formally begin, depending on the reasons for your divorce. Here is more on what to expect.

The process in a nutshell

Once you meet the conditions for filing for divorce and serve your spouse the necessary paperwork, it officially kicks off the proceedings. They have 35 days to respond. How things will play out from here depends on whether you can agree on pertinent issues like child support and custody, property division and alimony.

You can submit a mutual divorce settlement agreement to the court outlining the terms you have both agreed upon. Once the judge reviews and approves the agreement, you will be issued with a final judgment of divorce settling the divorce, often within a few months.

If your divorce is contested, the court will be involved in resolving the contentious issues, which typically results in a longer and more complex legal process. The case may proceed to trial if necessary. Court backlogs and the complexity of issues can considerably extend the timeline.

Legal guidance as you navigate a divorce can be invaluable in learning more about how things work, protecting your rights and avoiding mistakes that could delay the process or harm your interests.
