The legal limit in New Jersey, or the upper limit for blood alcohol concentration (BAC), is typically set at 0.08%. This applies to most drivers in most situations. While it is possible to be arrested for impaired driving even below this limit, breaking the limit and failing a breath test generally leads to an immediate arrest, and the court can presume you were impaired by alcohol.
As noted, however, the 0.08% limit is something that applies to a large majority of drivers, but not 100% of all drivers on the road. There are two other limits to be aware of, which could each lead to an arrest.
A commercial driver’s license
To begin with, a commercial driver needs to be extra careful about alcohol use. Their limit is 0.04%, or half the limit that applies to most drivers. A commercial driver could be a bus driver, for example, or a truck driver who operates an 18-wheeler.
Underage drivers
Next, drivers who are under the age of 21 have a legal limit of just 0.01%. This is effectively a zero-tolerance law. These drivers are young enough that they should not be purchasing or consuming alcohol in the first place, let alone when they drive. So, if there is any evidence that they have even a small amount of alcohol in their system while they are behind the wheel, it can result in serious charges.
